Woodbury Man Convicted Of Assault By Strangulation

The 21-year-old who choked his stepbrother during an Oct. 15, 2010, incident in Woodbury was given probation.

A Woodbury man convicted of domestic assault by strangulation was sentenced to probation in Washington County District Court on Sept. 14.

Charles John Gillard, 21, choked his stepbrother during a dispute at a home at the 1300 block of Clippership Alcove in Woodbury on Oct. 15, 2010, according to the criminal complaint.

His stepbrother was home sick from school and came downstairs after Gillard began yelling and swearing, according to the complaint.

Gillard then grabbed his stepbrother by the throat and forced him to the ground; the victim had difficulty breathing and later vomited, though it’s unclear if it was related to his sickness or the choking.

Other stipulations of the sentencing also imposed on Gillard:

  • serve three days in jail with credit for three days served;
  • complete chemical dependency evaluation;
  • complete mental health programming including taking prescribed medications at the direction of a mental health professional;
  • abstain from the use of chemicals, including alcohol, and submit to random testing;
  • have no same or similar offenses and remain law abiding;
  • complete an intake for cognitive skills programming and follow the recommendations; and
  • pay a $50 fine and provide a DNA sample.
