Should School Policies Override Medical Conditions?

Any one know of a great attorney to pursue legal action against the school district and their discrimination against children with medical needs?

OK, should have known that something would interefere with my good mood today. 

Has anyone had issues with the Washington County School District truancy policy because your child has a medical condition?

A couple of month ago I had to attend a Truancy Meeting as my son missed several days of school for medical reasons; not to mention he was rushed to an emergency room to due to a mishap at school which caused him to miss a week.  I explained to the County Attorney that my son has several medical conditions that he has been diagnosed with over the past few years: Anxiety and Adjustment Disorder, Oppositional Behavior Disorder, ADHD and hereditary migraines which was diagnosed by a neurologist.  He indicated that they do not like to bring medical cases to court.

Since the beginning of the school year he has had several debilitating migraines which consist of nausea, sometimes vomitting, and takes a few hours in a dark, quiet room to become manageable.  Yes, he get this condition from yours truly.  I sympathize with him as I had several trips to the Urgency Room for migraine cocktails this year.  Most people can take migraine medication, but because my son is already on medication, his medical doctor doesn't want to over-medicate him when he is still a growing kid.

Do to the migraines and anxiety, my son missed a few more days of school since this truancy meeting.  We have been required to sign a "Truancy Contract" with the Assistant County Attorney and medical releases for the Washington County Social Worker. During this two hour meeting we discussed my son's medical condition and it is noted that he is to come to school with his migraine, go directly to the school nurse so it is noted, and he can lay down for whatever time deemed neccessary or return home.

The following week he had a migraine and nausea, still went to school, was able to lay down for 15 minutes until the nurse instructed him to go to class.  He was told to find some Aleve or Tylenol from a classmate to assist with his headache.  My son contacted me and I authorized him to walk out of the school.  He was home in bed until almost 8pm with this migraine and wasn't able to eat until almost 9pm.  I contacted the assistant principal and he blew off the incident.

Today the migraine was so bad that he vomitted and felt dizzy.  Again, I forced him to go to school and to the nurse's office per the truancy contract.  During his visit in the nurses office he was told to go back to class and that it was his problem that he "played sick" in the past, told the other nurse in the office "watch out for him because he has a tendency to leave school" and to go back to class after a 20 minutes. 

I just spoke with the school nurse and confronted her on this situation.  She indicated that her comments were not directly related to my son.  Said that most students have a tendency to leave school after visiting the nurses office.  Indicated that my son's medical condition was not relayed to her, yet I have spoken with her in the past concerning his condition.  She indicated that if he has such a migraine he should be on medication for it.  As a school nurse, she is not his medical doctor and has overstepped her boundaries.  I informed her that his medical doctor does not want him on any other medications because he already takes medication for something else. 

I am highly frustrated with this situation. The school district and their "policies" are biased when it comes to children with medical conditions.
