County Asks for Second Mental Evaluation for Man Accused in Oakdale Murder

A mental evaluation performed last month found Nhan Tran, the man accused of gunning down 9-year-old Devin Aryal, unfit to participate in his own legal defense. Prosecutors are seeking a second opinion.

An emotional scene unfolded Monday as accused gunman Nhan L. Tran made an appearance in Washington County District Court for a brief hearing releasing results from a court-ordered mental evaluation.  Tran, 34, whom doctors deemed "unfit to participate in his own legal defense" and unable to determine right from wrong, is charged with multiple felonies, including murder, after he was arrested the night of Feb. 11 in Oakdale.  According to police records and court reports, it's believed Tran opened fire on a busy road outside of his Oakdale home, firing at random motorists. One person, fourth-grader Devin Aryal, was killed when a bullet struck him in the head.  Devin's mother, Missy, was in court Monday, along with Tran's family. Both sides …

Perhaps next you want to start posthumously prosecuting people who commit suicide?   more ›

Kally, I couldn't agree with you more!! Whats with the 2nd degree murder charge? This animal loaded his weapon, ( guns don't load up themselves) had every intention of murder, (you can't order a gun to fire on it's own) and went out to find his targets.Thinking & carrying out his PLAN should certainly constitute 1st degree with "intent" to commit murder. Are we looking the other way because this …   more ›
